These General Terms and Conditions apply to all brokerage and advisory services of Michael Zimmer GmbH (the "Broker") towards consumers and businesses.
The Broker provides introduction and brokerage services for the purchase, sale and procurement of motor vehicles in Germany and abroad. No purchase contract is concluded with the Broker unless expressly agreed.
Vehicle presentations on the website are non-binding. Only the Broker's written confirmation of a concrete offer is binding.
The amount of the brokerage commission is agreed individually before conclusion of the contract and confirmed in writing.
Delivery times and transport routes are agreed individually. Transfer of risk and insurance are governed by the agreed Incoterms or the statutory provisions.
As the Broker is generally not the seller, claims for defects are directed against the respective seller. The Broker supports the customer in asserting justified claims.
Consumers have a statutory right of withdrawal in distance contracts. The withdrawal instruction is provided before conclusion of the contract.
The Broker is liable without limitation for intent and gross negligence and pursuant to the German Product Liability Act. Otherwise, liability is limited to foreseeable damage typical of the contract.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of performance and jurisdiction for merchants is Kiel.
